(a) Services: Computer Finger will attempt to diagnosis your technology problem, provide an estimate of applicable service fees (plus applicable taxes), and then provide you with a technology solution In some cases, severe technical difficulty such as inability to log onto the internet or machine not responsive enough for remote access or repair or other situations that are beyond our control will not be able to be repaired remotely, over the internet. We will decide on a case by case basis if you and your computer qualifies for remote service and if we can provide that service to you. If remote service is not an option for you, you may be eligible for on-demand onsite service based on your geographical area at varying prices.

(b) Support: Support services may be offered to you over the telephone or via the Internet if your computer is one of our supported operating systems you have a working high speed internet connection. If you elect to receive remote support, then Computer Finger remotely logs on to your computer for a technical session that may include reboots, reconnects and programs may be installed and uninstalled so as we see fit until your problem is resolved. By electing to receive remote support, you agree to allow Computer Finger to use whatever tools deemed necessary to repair your computer. We respect your privacy and so remote access software tools used do not allow initial connections without permission. All permission must be granted by the user. Once a session is completely terminated no further reconnection is possible.

(c) Software Download or Installation Services: Software products may be offered to you by Computer Finger based on your individual needs. If you elect to use or purchase one of these products you agree that warranties are not expressed. Any liabilities or damages from any product not created or written by us, we will not hold any liabilities for and those products should be warranted by the third party producer of the product. Computer Finger does not warrant or make any representation about the services or software provided by the third party.

(d) Your Responsibility: You agree that Computer Finger is not responsible under any circumstances or in any situation for any loses or damages to data, files, software or hardware. We are careful but there are just too many unforeseen events that can always occur for one reason or another, like having a pre-existing condition on your hard drive for example with a bad sector that during a defrag, you can lose everything. Any and all services, products and programs are completely without warranty or liability of and kind. You completely agree that we are not responsible whatsoever and you should first backup any information stored on your machine in the rare event of a loss. You acknowledge and agree that Computer Finger shall not be responsible under any circumstance for any loss or corruption of data and/or software or damages to hardware of any kind.

SERVICE LIMITATIONS; LIABILITY

(a) LIMITATIONS TO SERVICE: COMPUTER FINGER RESERVES THE RIGHT TO REFRAIN FROM PROVIDING ANY OR ALL REQUESTED REMOTE SERVICES AND INSTEAD REFUND YOUR PAYMENT, WHOLLY OR IN PART, ON THE BASIS THAT YOUR TECHNICAL NEEDS OR OTHER REQUIREMENTS ARE UNUSUAL OR EXTENSIVE AND BEYOND THE SCOPE OF THIS SERVICE AGREEMENT AS REASONABLY DETERMINED BY COMPUTER FINGER.

(b) FORCE MAJEURE: If Computer Finger’s ability to render remote services is impaired by you or circumstances beyond our control, we may choose not to provide or to discontinue remote services at any time.

(c) LIMITATION OF LIABILITY: To the extent permitted by law, you agree that Computer Finger’s total liability for any damages related to its services is zero. You completely release Computer Finger from liability for any indirect, incidental, special, or consequential damages. COMPUTER FINGER IS NOT LIABLE FOR LOSS, ALTERATION, OR CORRUPTION OF ANY DATA OR FOR YOUR INABILITY TO USE YOUR COMPUTER EQUIPMENT OR OTHER PRODUCT.
